If the married couples are unable to live together in peace and resolve to separate, there is always a way out. In Islam, it is most disliked permission for the couple to seek separation.
- Quran says: - If you dislike anything in your spouse, Allah has created many better things in them, which you should appreciate.
- If the two parties husband and wife, unable to live together peacefully, each should appoint one elderly person from them for arbitration. They will find out the pricking point in the relationship and resolve the dispute.
- If the husband wants separation from his wife, he has to pronounce talaq when his wife is clear from her menstrual cycle and before two witness. Still he has to keep her in the same house for iddat of 3 months though separate bed. In the meantime, when the temper of the husband cools down, finding the wife in the same house, he may come closer to her. Casually they forget the differences and come closer and consummate. This way, the pronouncement of talaq is broken and they are once again man and wife. There is no need of fresh nikah. But again if the husband gives talaq for econd time and wants to take back his wife, he has to get fresh Nikah formality. If he gives talaq for the third time, after this, he cannot get her back unless, she gets married to another man, and he divorce her. In case the wife wants separation from the husband, she has to forgo some mahar and get the divorce if the husband demands. The husband cannot claim anything, gold jewels gifts whatever given to the wife during married life
In case they separate through a divorce, both should part away peacefully. They should not carry forward their anger and hate further. They should not disgrace each other. They should forget and forgive all the bitterness of the past.
